Scotland County Hospital and Achim Hoyal Respond to Suit Filed by Former CEO

MEMPHIS, Mo.- A former hospital CEO has filed suit against his former employer and a current hospital employee. Dr. Randy Tobler, former CEO of Scotland County Hospital in Memphis, filed suit on Wednesday morning in Scotland County Circuit Court against Scotland County Hospital and Achim Hoyal. In a statement submitted to KMEM News on Thursday afternoon by Dr. Tobler’s spokesperson, Sammi Tobler Gregory, it states that the suit is on the basis of violations of the Missouri Sunshine Law resulting in irreparable damage to Dr. Tobler’s reputation as well as the Scotland County Hospital community.

In the statement, Dr. Tobler is quoted as saying “The actions taken by a group of board members, their agent and complicit executives now in leadership at Scotland County Hospital leave me no choice but to file this lawsuit. Their actions resulted in the suspension of my staff privileges, immediately preventing access to my patients.”
In addition to the alleged violations of the Sunshine Law, Dr. Tobler’s statement also included allegations of slander, defamation, civil conspiracy and interference with his professional relationship with his patients.
When asked for comment on the pending litigation, Scotland County Hospital and Achim Hoyal issued a joint statement which reads “As a quasi-public governmental body, the Board acted in the best interests of the hospital and community to safeguard public funds. The Board and Mr. Hoyal intend to vigorously defend against the lawsuit brought by Dr. Tobler, and look forward to presenting our defense in court.”
